Dear High Commissioner, Mr. Volker Türk,
The Civil Committee for the Rescue of Hostages and Political Prisoners of Tajikistan hereby formally informs you of its deep concern regarding serious violations of the rights of the children and relatives of Zayd Saidov.
It should be recalled that in connection with the case of political prisoner Zayd Saidov, the United Nations did not remain indifferent and declared his detention and long-term imprisonment unlawful, calling on the Government of Tajikistan to release him unconditionally.
Unfortunately, Tajikistan not only ignored this request, but over the years confiscated all industrial enterprises established by this entrepreneur in favor of the state. Several enterprises that had provided employment to hundreds of people ceased operations. Despite this, the authorities failed to recognize that Zayd contributed significantly to Tajikistan’s economy and helped prevent labor migration among young people by creating jobs. In relation to his case—already deemed unlawful by the UN—there are clear indications of serious human rights violations, including the right to housing and property.
Since the case against Zayd Saidov was fabricated by the authorities, the court was unable to prove that his property had been obtained illegally. According to the Criminal Code of Tajikistan, property may be confiscated only if it is proven to have been acquired unlawfully. Zayd Saidov, known in Tajikistan as a successful businessman and developer, was also a trusted partner for foreign investors, who preferred to work specifically with him, viewing him as a guarantee of security.
A person who donated 2 million from his own funds to help build a major hydroelectric power plant in his country and save people from electricity shortages—how could such a person be accused of embezzling state property? This is a question that Tajik authorities, who constantly seek assistance from international institutions, have never asked themselves. Even after his imprisonment, they have continued to persecute his relatives.
Zayd Saidov has been imprisoned for 13 years, and throughout this time, law enforcement authorities have continued to harass his family members. For thirteen years, the government has threatened this family with eviction, and nearly 30 of his relatives have suffered psychological distress.
A few days ago, the businessman’s son appealed to the Government of Tajikistan through social media and Radio Ozodi, asking that they not be deprived of their homes. According to international law, the sole residence of a convicted person and their family cannot be confiscated, especially if children live there.
The Constitution of the Republic of Tajikistan also states that “the state must protect citizens from homelessness.” However, the Government of Tajikistan, and personally President Rahmon—who is the guarantor of the Constitution—has been violating this provision and undermining the guarantee of citizens’ right to live freely in a state governed by law. Twenty-seven members of the family, including 17 children, are now being punished for the “crime” of their father, in violation of international standards.
The Civil Committee for the Rescue of Hostages and Political Prisoners of Tajikistan is deeply alarmed by these inhumane actions of the Tajik authorities. We respectfully request that you address this issue and, through appropriate pressure, call on the Government of Tajikistan to put an end to these violations of human rights.
